The decision was signed by the city district judge on duty, Marília Augusto de Oliveira Plaza, during a custody hearing this Sunday (12).
The accident occurred on Saturday night (11). According to the Military Police, Leiliane was driving a Volkswagen Gol when she went ahead at an intersection and collided with a Mercedes-Benz Sprinter.
With the impact of the collision, the baby suffered a sinking skull, was rescued and taken to a health unit, but did not survive the injuries.
The collision was recorded by security cameras (see below).
In the decision, the judge highlighted that Leiliane is a primary defendant, has a fixed residence and family ties in the municipality.
“There are no concrete elements that indicate a risk of escape or repeat offenses that justify precautionary segregation at this time,” stated the judge.
Despite granting freedom, the judge highlighted that Leiliane was driving without a National Driving License (CNH) and disrespected the yield signs at the intersection.
Another point highlighted was the result of the alcohol test, which indicated that the driver had consumed alcohol before the accident.
Given the seriousness of the facts, the judge ordered precautionary measures to be complied with, including attendance at all acts of the process for which she was summoned and the obligation to keep the address and telephone number up to date.
“On the other hand, the seriousness of the facts — manslaughter of a 6-month-old child, driving a vehicle without a license and under the influence of alcohol — requires the adoption of precautionary measures other than imprisonment, sufficient and appropriate to guarantee the application of criminal law and procedural instruction”, highlighted the judge.
