Confresa City Hall terminated a contract with PHB Construtora Ltda. after pointing out partial execution, unjustified delays and constructive defects in the services performed by the company.

The administrative decision, published this Wednesday (22), also determines the imposition of a fine and prohibits the construction company from participating in tenders or signing new contracts with the public administration for a period of two years.

The punishments are related to Administrative Contract No. 069/2024, linked to Agreement No. 005/2024, signed with the State Secretariat for Infrastructure and Logistics of Mato Grosso (Sinfra).

According to the decision, the city hall recognized the existence of “serious contractual breach” on the part of the construction company.

In addition to the termination, the fine and the impediment to contract, the municipality ordered the retention of R$894,700.83, corresponding to the remaining balance of the contract.

The money must remain retained until the conclusion of the investigation, with the discount of any technical disallowances. The final value of the fine will still be calculated based on the percentage established in the contract notice.

The company will have a new deadline to present a statement specifically about the size of the fine to be applied.
