The judge concluded that the former president failed to comply with precautionary measures by writing a letter of support for his son, Senator Flávio Bolsonaro's presidential pre-candidacy, which was later published on social media. In the message, Bolsonaro reiterated his support for his son and appealed for unity, after public criticism from Bolsonaro supporters of Michelle Bolsonaro, the former president's wife.
Moraes welcomed the understanding of the Attorney General's Office, which considered that the episode did not justify the revocation of house arrest, but rather the imposition of new restrictions to prevent any interference in the electoral process.
The decision also prohibits the publication of political or electoral manifestos prepared by Bolsonaro, remembering that his political rights are suspended after his conviction for an attempted coup d'état.
The minister also maintained the sanction applied to Flávio Bolsonaro, who since July 13 has been banned from visiting his father for 90 days for publishing the letter. He also rejected the defense's argument, which claimed ignorance of the publication.
Since July 2025, Bolsonaro has been prohibited from using social networks, directly or indirectly, or from using third parties to disseminate content.
Moraes warned that all precautionary measures remain in force and that any new non-compliance could lead to an immediate review of the benefit, including the revocation of house arrest and the return to the closed regime.
The first round of presidential elections, scheduled for October 4, will have as main candidates Flávio Bolsonaro and the current president, Luiz Inácio Lula da Silva, who is seeking a fourth non-consecutive term.
Bolsonaro has been under house arrest since March, when he was medically discharged after suffering from bronchopneumonia and Moraes authorized the measure for humanitarian reasons.
The sentence of 27 years and three months began to be served in a closed regime, before the Federal Supreme Court authorized his temporary transfer home for health reasons.
