Former federal deputy Flordelis dos Santos de Souza was ordered by the Rio de Janeiro Court to pay compensation for moral damages to the father and sister of pastor Anderson do Carmo, shot dead on June 16, 2019, in Niterói, metropolitan region.

Judge Marco Antonio Novaes de Abreu, from the 3rd Civil Court of Bangu, set compensation of R$100,000 for the father, Jorge de Souza, and R$100,000 for the sister, Claudia Maria Rodrigues Souza. The amounts will be adjusted by the Selic rate from the date of the sentence and will be subject to interest of 1% per month until August 2024.

The convicted woman, who was also known as an evangelical pastor, will have to pay court costs and legal fees of 10% of the value of the conviction.

According to the sentence, published on August 5, the criminal justice system had already recognized Flordelis as having ordered the murder of her husband, and the civil court was only responsible for deciding the existence and value of compensation for family members.

The Court applied to the case the understanding that, when the victim of a crime dies, the pain suffered by the father, mother and siblings is considered presumed - there is no need to prove the suffering in court, because the loss itself is sufficient as proof of the damage.

Summoned in person at the Talavera Bruce Prison Unit, where she is serving her sentence, Flordelis did not present her own defense and had her absence declared.

The defense in the case then fell to the Public Defender's Office, which attempted to transfer the case to another court. The request was denied. The defense only questioned the amount requested by the authors, without contesting the facts.

The action was filed in 2021 by the pastor's father, sister and aunt, requesting urgent relief to seize assets and block the defendant's credits, in addition to compensation of R$500,000, R$200,000 and R$100,000, respectively. The aunt's request was denied, as the law only covers close family members.

The sentence can still be appealed to the Court of Justice of Rio de Janeiro, within 15 working days. According to the general rule of the Code of Civil Procedure, the appeal has a suspensive effect, which may postpone the execution of the compensation until the judgment of the appeal, if it is presented.

Flordelis was sentenced by the jury, in 2022, to more than 50 years in prison for being identified as having ordered the pastor's murder, in addition to other crimes related to the case.
