The man was convicted of rape of a vulnerable person, qualified rape and felonious rape. According to the TJRS (Court of Justice of Rio Grande do Sul), he must begin serving his sentence in a closed regime. The court also maintained his preventive detention.
The crimes occurred inside the house over several years. According to the process, the abuse took place between 2013 and 2023. The complaint states that the man took advantage of his status as a father and the authority he had over his daughters to commit the crimes.
One of the victims reported having suffered violence from the age of 8 to 13. According to TJRS, the abuse against the other daughter occurred during her adolescence.
The Court considered the victims' reports to be coherent, detailed and compatible with the other evidence. The sentence highlighted that sexual crimes committed within the family usually happen silently and away from witnesses. Therefore, the decision stated that it is necessary to carefully analyze the words of the victims and the way in which this type of violence occurs in the family environment.
The decision also cited the impacts caused to the victims. As recorded in the process, the young women reported difficulties sleeping and eating, panic attacks, self-mutilation, a drop in school performance and the need for psychological support because of the abuse they suffered.
The court took away the father's family power over his daughters. The sentence highlighted that he precisely used his status as a father to commit the crimes. The decision stated that sexual violence committed against one's own daughters represents an absolute violation of the duties of paternity and protection of children and adolescents.
The man was ordered to pay compensation to the victims. In addition to the prison sentence, he will have to pay a minimum compensation equivalent to ten minimum wages for each daughter, as compensation for moral damages.
The crime of rape is provided for in article 213 of the Penal Code. The initial sentence varies from six to ten years in prison, up to 12 years in the case of bodily injury and 30 years in the case of death.
The legislation also provides for punishment for disclosing a rape scene, provided for in article 218-C of the Penal Code, with a penalty of one to five years in prison.

It is not necessary to file a police report to receive medical and psychological care in the public health system. However, the corpus delicti examination depends on the police record.
This examination can be carried out later, but it is recommended that it be carried out as close as possible to the moment of violence, to preserve evidence.
