ANA POMPEUBRASÍLIA, DF (FOLHAPRESS) - Banco do Brasil requested, this Thursday (6), exemption from the conciliation hearing scheduled by Minister Luiz Fux, of the STF (Supreme Federal Court), to define the execution of the agreement signed in May to save BRB (Banco de Brasília).

BB states that BRB's request for the meeting did not include a call to banks and that it did not represent itself as a representative of other financial institutions. Finally, it also says that the president of Banco do Brasil, Tarciana Medeiros, has another commitment at the time of the meeting.

If the subpoena is maintained, the institution states that the others should also be called.

BB was chosen as leader of the consortium of banks that will serve as guarantors for the R$6.6 billion loan operation from the FGC (Credit Guarantee Fund) to the government of the Federal District for the capitalization of BRB.

The decision of the case's rapporteur at the Supreme Court was taken this Wednesday (5) following a request from the government of the Federal District, which claimed there was inertia on the part of the Union in complying with the agreed terms. The new meeting is scheduled for August 13th.

The action seeks to cover the hole left in BRB by operations with Banco Master, owned by Daniel Vorcaro. In February, the bank delivered a document to the Central Bank with a set of preventive capital recovery actions to be implemented within 180 days. The deadline passed this Wednesday (5) without the measures having been written.

"There was never a consortium of banks established, nor did Banco do Brasil position itself as a representative of other financial institutions or responsible for any operation, so much so that it is not even part of the procedural relationship of this ACO. Furthermore, Banco do Brasil does not have a mandate from any financial institution to assume any obligation", says BB.

Banco do Brasil representatives state that the DF is questioning the Union and the FGC, intending to directly link resources from the FPE (State Participation Fund) and the FPM (Municipal Participation Fund) to guarantee the FGC, which would dispense with the guarantee that would initially be provided by the Banks.

"If the format proposed by the Federal District no longer provides for the granting of bail by the banks, their respective participation in the hearings would be unnecessary. And in the event that Banco do Brasil's participation is maintained, the other banks should also be summoned to the hearing", he states. In the same document, BB adds information about the president's agenda for next week. According to the image, she has "an essential participation, together with the board of directors, in the public presentation of BB's quarterly results, as previously disclosed to the market."

In this case, if the rapporteur still insists on his presence, the bank requests the possibility of being represented by the legal director, Alexandre Bochetti Nunes.

Also this Thursday, the Minister of Finance, Dario Durigan, stated that members of the federal government received with "deep dissatisfaction" the statement from the Government of the Federal District that there would be inertia on the part of the Union in the negotiations to facilitate a solution to the BRB crisis.

According to Durigan, the economic team's assessment is that the accusation is "totally unreasonable", since the federal government participates in the negotiations at the STF, although the problem originates from facts linked to the BRB itself within the scope of the Banco Master scandal.

"The BRB problem has criminal origins in the Government of the DF and in the BRB. The Union, which has nothing to do with this story, we have never had any relationship with these types of people, was called to the Supreme Court, at the request of the governor [Celina Leão], we were willing to go to the Supreme Court, we closed the possible agreement", criticized the minister.

According to Durigan, Finance technicians hold several meetings to facilitate the guarantees offered by the district government and analyze, together with the banks and the FGC, the structure of the operation. He stated that the main obstacle today is not the Union's actions, but the presentation of a business plan considered credible for the recovery of BRB.

The minister said that the federal government will take this position to the hearing with Fux at the Supreme Court and once again held the GDF responsible for the delay in negotiations. "Nothing is stopped today in the federal government. There is no inertia," he stated.
