Resident of Palmas has been waiting for two years for his car to be returned to a workshop. Mechanic Kelvin Lucas, 31 years old, has been waiting for more than a year for a 2009 BMW 118i to be repaired. The luxury car was left at a workshop in Palmas in early 2025 for an engine repair and, according to Kelvin, more than R$26,000 was paid in advance for the service. In an interview with TV Anhanguera, he said that he continues to pay the Motor Vehicle Ownership Tax (IPVA), even without being able to use the vehicle. (Watch video above). The case was taken to court, which has already issued two orders for immediate repairs and delivery of the vehicle. In March of this year, due to non-compliance with the determinations, the Court imposed a daily fine of R$500 on the workshop, limited to a ceiling of R$15 thousand. According to the decision to which TV Anhanguera had access, the company was notified, but did not return the car or provide a justification for the delay. In a note sent to the reporter, the workshop informed that the vehicle has been ready since May this year and that it is just waiting for Kelvin to collect the car. ? The consumer said that, when trying to pick up the car in April, he found the vehicle in a worse condition than when he delivered it. According to him, the car had a failing engine, burnt out headlights and faded paintwork as a result of having been exposed in the company's courtyard. "How am I left? Without the car, without the money that was paid... My car ended up there, full of details, with burnt paint (...) Am I going to be at a loss? Am I going to have to take the car in the situation it is in and spend it somewhere else? I went to look for a professional to fix it, and what I ended up with was a headache", he said. "I still have to pay the IPVA for the car that I'm not even using, which, in fact, is finished. Today I saw the condition of the car. It was supposed to be fixed, not destroyed", said the owner. In cases like this, lawyer Vinícius Negreiros, consulted by TV Anhanguera, explained that the consumer can demand forced fulfillment of the obligation or reimbursement of the amounts paid, with monetary adjustment. "The solution is to ask for the conversion of this legal action into an action for material damages, right? In this case, you will seek reimbursement in court for the full value of that vehicle. You demonstrate that there was no restitution, that there is no longer this possibility of restitution and, then, you ask for the conversion of this procedure into an action also for material damages", he stated. According to the lawyer, in extreme cases, in which the restitution of the property is not satisfactory, it is also possible to request the conversion of the action into material damages. This allows the consumer to seek the full value of the vehicle in court, if it is demonstrated that the car was not returned or suffered damage during the period in which it was under the workshop's responsibility.
