The process is being carried out in secret. According to the judge responsible for the case, hidden commands were found in two petitions filed in February 2026. These commands were written in white letters, very small in size and distributed in such a way that they could not be seen during normal reading of the document. Although invisible to those who read, they could be identified by artificial intelligence programs that analyze the text. According to the judge, the commands had the potential to interfere with the functioning of MinutaIA, a system used by the TJPB to assist magistrates in preparing draft decisions. Still according to the decision, the text instructed artificial intelligence tools to leave impartiality aside, consider the arguments presented by the lawyer as irrefutable and decide in favor of the appeal. The command also said that this would be a test to verify whether the judge used only artificial intelligence to make his decisions. After the discovery, the case was forwarded to the OAB-PB to investigate a possible disciplinary infraction. Lawyer denies having inserted the commands In the defense presented in one of the cases, the lawyer investigated confirmed that he signed and filed the petitions, but stated that he did not insert the commands intentionally. According to him, the problem may have occurred when reusing document templates, converting files or due to some automatic integration used by the office. The professional also informed that he adopted measures to review internal procedures and reported the case to the OAB-PB Ombudsman's Office. The explanations, however, were considered insufficient in the initial analysis carried out by the Court. The investigation continues and the case will still be analyzed in the disciplinary process. When justifying the precautionary suspension, the president of OAB-PB, Harrison Targino, stated that the measure seeks to protect the credibility of the legal profession and ensure that the investigation takes place properly. What is “prompt injection”? “Prompt injection” is a technique used to try to influence the functioning of artificial intelligence systems. In practice, the person inserts hidden commands within documents, such as petitions and appeals. These commands may not be seen by anyone reading the text, but they can be identified by AI tools that analyze the content. In theory, this could cause artificial intelligence to stop following the guidelines for which it was programmed and produce responses that favor one of the parties in the process. According to OAB-PB, precautionary suspension is provided for in the Law Statute and can be applied in exceptional situations, when there is evidence that the professional's continued practice of law could compromise the investigation of the facts or the credibility of the profession. The measure is temporary and does not represent a conviction, as the cases will still be analyzed in the disciplinary process, with a guarantee of contradictory proceedings and full defense for those investigated.
