When deciding, Alexandre de Moraes understood that maintaining the TJ-SP decision could cause serious damage to the administrative order and the public economy. According to City Hall, the court's decision created a "normative vacuum" in the collection of IPTU for 2025 and put around R$150 million in revenue at risk. In a note, the City Hall informed that taxpayers must continue to pay the 2025 IPTU as normal. The municipality also stated that the update of the Generic Value Plan was made based on technical criteria and that 58% of taxpayers had a reduction in the tax amount this year. Remember the case In June, the Special Body of the TJ-SP declared unconstitutional the decree that updated the Generic Value Plan (PGV), used as a basis for calculating IPTU, as it understood that a real increase in the tax calculation base cannot be made by decree. In the same trial, the judges maintained Complementary Law No. 1,001/2025 was valid, which reestablished the 1998 legislation on the PGV. The City Hall appealed to the STF, claiming that the TJ-SP's decision left the municipality without legal support for charging the 2025 IPTU. When analyzing the request, Alexandre de Moraes suspended the effects of the São Paulo court's decision until the final judgment of the actions.
