According to Flávio Dino, the procedure adopted by the House may have violated Binding Precedent No. 46 of the STF, which establishes that it is the exclusive competence of the Union to define the rules of procedure and judgment for the impeachment of mayors. The minister highlighted that the decree-law determines that, in the first session after receiving the complaint, the Chamber must read the document, deliberate on its receipt, constitute the processing committee and elect its president and rapporteur in the same session. According to the decision, the complaint was presented in February, but it was read and received only in a session held on March 2, after a postponement approved by the councilors. For the rapporteur, on a first examination, failure to comply with this rite could constitute usurpation of the Union's legislative competence, regardless of possible harm to the mayor's defense. With this understanding, he granted the injunction to suspend Legislative Decree No. 916/2026, which revoked Colonel Sandro's mandate, and determined his immediate reinstatement to the position.
