Marcelly Peretto (right) is accused of involvement in the death of Igor, her brother Reproduction/Social Networks According to the decision, obtained by g1 this Friday (17), the defense filed habeas corpus under the argument that Marcelly "suffers illegal embarrassment". The lawyers claimed that the MP-SP had missed the deadline to present witnesses and request investigations before the jury. Thus, the defense wanted the TJ-SP to recognize estoppel, when the party loses the right to perform a procedural act because they let the deadline pass. If the request were accepted, this statement from the prosecution could be removed from the process. Despite this, the TJ-SP maintained the demonstration was valid and did not recognize any illegality in the progress of the case. According to rapporteur and judge Geraldo Wohlers, the MP-SP responded within the deadline, as the electronic subpoena is only considered carried out when the party consults the system. g1 contacted Marcelly's defense, but did not receive a response until the last update of this report. Death of Igor Rafaela Costa (left) and Marcelly Peretto (right) arriving at the apartment where Igor Peretto was killed Reproduction The crime took place on August 31, 2024, in Marcelly Peretto's apartment. Inside the property were the victim, Marcelly and Mário Vitorino. Rafaela arrived at the apartment with Marcelly, but left 13 seconds before her husband arrived with the suspect for the murder. According to the statements of the trio and the lawyers, the widow Rafaela had an affair with Mário. Marcelly's lawyer also said that the client and Rafaela had a romantic relationship there before Igor and Mario arrived at the apartment. Igor Peretto was stabbed to death and would have been quadriplegic [with no movement from the neck down] if he had survived. The information is contained in a necroscopic report obtained by g1. The women turned themselves in and were arrested on September 6, while Mário was detained after being found hiding in the house of Rafaela's uncle, in Torrinha (SP), on the 15th of the same month. Decision Mario Vitorino, Marcelly Peretto and Rafaela Costa were arrested for their involvement in the death of Igor Peretto Civil Police In addition to ordering the widow's release, judge Felipe Esmanhoto Mateo disqualified Rafaela from the complaint, claiming that the accused was not in the apartment at the time of the crime and the evidence collected was not sufficient to establish that she had participated in the murder. The judge determined that Mario and Marcelly will go to the popular jury for triple murder: for a bad reason (relationship between the accused), a cruel motive (several knife blows) and a resource that made the defense difficult (victim unarmed and attacked by someone close to him).
