Senator Acir Gurgacz in the Senate plenary on November 1st Pedro França / Agência Senaod Minister Nunes Marques, of the Federal Supreme Court (STF), granted an injunction that returns eligibility to former senator Acir Gurgacz (PDT-RO), convicted in 2018 for a crime against the financial system. Monday's decision (3) clears him to run in the October elections, but the case will still undergo evaluation by the Second Panel of the STF. The minister responded to a request from the defense and understood that there were flaws in the rules of the legal process. At the time, Gurgacz's lawyers warned that the STF was not the correct court to judge the case. This is because the crimes would have happened between 2003 and 2004, before he took office as senator. Although the ministers debated the matter, they voted on the process without submitting the issue to a formal and nominal vote to decide whether it was the right court for the case. The defense claims that the sentence has already been served and the damage paid. The urgency of the preliminary decision was determined by the proximity of the 2026 electoral calendar deadlines. Party conventions end on August 5th, and the deadline for registering candidacies ends on August 15th. Acir was nominated by the PDT as a candidate for the senate at a convention held in July 2026.
