The resolution regulates cases in which children and adolescents need court permission to participate in digital content, especially when there is monetization or promotion that routinely exploits their image, routine or artistic activity. ? Therefore, the granting of a judicial permit must observe principles such as absolute priority, the best interests of children and adolescents, full protection and the dignity of the human person. The document also highlights that the role of the Public Prosecutor's Office is mandatory in all requests for judicial authorization. Furthermore, whenever possible, the child or adolescent should be heard, according to their age and level of development, guaranteeing the right to participation and qualified listening. To request judicial authorization, it will be necessary to present information such as the description of the activity, the forms of monetization, the contracts signed, the advertising involved, the history of exposure on digital platforms, the school routine, health conditions and other data that make it possible to assess whether the activity serves the best interests of the child or adolescent. When granting the permit, the judge must define limits for carrying out the activity, such as duration, frequency of participation and execution conditions. The decision must also provide for measures to protect the health, education, leisure, family life, privacy and property of the child or adolescent. The rule prohibits the participation of minors in content of a sexual or erotic nature, degrading or humiliating, abusive advertising to children, betting and gambling, hate speech, discriminatory practices and other situations that may violate their rights. If signs of economic exploitation, irregular child labor or other violations are identified, the judge must notify the Public Prosecutor's Office, the Public Labor Ministry (MPT) and the Guardianship Council. To support the work of prosecutors, the Center for Operational Support for Children and Youth (CAO-IJ) made available, on the institutional intranet, opinion models for requests for judicial authorization related to the participation of children and adolescents in activities in the digital environment, in accordance with the guidelines of Resolution No. 687/2026 of the CNJ.
