Furthermore, the man directed derogatory expressions at the teenager, related to his health condition. The version was confirmed by witnesses, including the woman's mother and a military police officer who responded to the incident. The judge highlighted that the materiality of the crimes was proven by a police report, arrest report and corpus delicti examination. The expert report confirmed the existence of injuries compatible with the victim's report. The judge applied the Maria da Penha Law by recognizing gender-based domestic and family violence. The conviction for insult was based on legislation protecting children and adolescents, due to the discriminatory nature of the offenses, which sought to belittle the young person due to their disability. "The testimony of the teenager, the victim's son and a person with autism spectrum disorder, is worth highlighting, collected during the investigative phase before the police authority. His narrative proved to be spontaneous, coherent and compatible with the other elements in the case, especially regarding the offenses directed at him and the context of aggressiveness demonstrated by the accused", the judge wrote in the ruling. In addition to the prison sentence and the payment of a ten-day fine, the Court ordered the defendant to pay R$2,500 as minimum compensation for moral damages to the victim.
