The case occurred on BR-101, close to Conjunto Cidade Satélite, in Natal. The decision was made by the 2nd Civil Court of the District of Rio Grande do Sul, handed down in April this year. According to the lawsuit, a company vehicle was struck by the defendant's car. The employee who was driving the car that was hit reported that the person responsible for the crash showed visible signs of intoxication and proposed an agreement to avoid calling the police. ? Before the vehicle arrived, the driver responsible for the accident fled the scene. Then, the defendant's twin brother returned to the stretch of highway wearing the same clothes as the driver to try to impersonate him and deceive the police officers and the victim. The hoax was discovered because the brother did not show signs of drinking alcohol nor did he have the injuries that the real driver suffered in the crash. The accident took place in February 2012. In the procedural defense, the defendant denied what happened. He stated that he was not the driver of the vehicle at the time of the accident, alleged a lack of evidence and classified the police report as a "one-sided document". The man asked for the charges to be dismissed and the car owner to be included in the process. The judge of the 2nd Civil Court rejected the arguments. The judge highlighted that the defense's allegation "is confused with the merits of the demand and the analysis of the evidence." In the sentence, the judge reinforced that the PRF accident report has a presumption of veracity and that the defendant did not present evidence to refute it, limiting himself to denying the facts in a general way. According to the judge, the police document "is not a mere statement from a party, but an official record from a public servant who attended the scene and verified the dynamics of the facts." The driver was ordered to pay R$7,487.61 for material damages and R$3,600.00 for lost profits, an amount referring to the need for the company that filed the lawsuit to rent another vehicle to maintain its activities.
