Public defender Othoniel Pinheiro explained that the agency filed a Direct Action of Unconstitutionality (ADI) to take the case to the Full Court. The objective is for the law to be considered unconstitutional only for the next selection processes, preserving the enrollments of approved students while the rule was in force. "We are defending that the law be declared unconstitutional, but that the registrations already carried out be preserved, with respect for legal certainty, the good faith of the candidates and confidence in the acts of the public administration", he stated. According to the defender, the 3rd Civil Chamber only analyzed the appeal presented by Uncisal and did not have the authority to decide on the practical effects of the declaration of unconstitutionality. "This discussion on the preservation of license plates must be carried out by the Full Court, in the direct action of unconstitutionality proposed by the Public Defender's Office," said Pinheiro. The defender also highlighted that the Federal Supreme Court (STF) has already declared similar regional bonus laws unconstitutional in other states, but preserved the enrollment of students who entered in good faith.
