The Jury Court session was presided over by judge Humberto Alves Júnior, head of the 1st Court of the District of Viana, who was responsible for the 2nd Criminal Court. According to the complaint, the crime took place around 4 am on November 27, 2010. The Public Prosecutor's Office maintained that Hélio killed Salomão with a shot in the chest after an argument that began when the victim accidentally hit the police officer's car while trying to park.

According to the complaint, Salomão was driving his brother-in-law's car, Genivam, who was willing to pay for the damages caused by the collision. During the discussion about the accident, Salomão reportedly stated that he would not pay for the damages. Then there was a fight and he was hit by gunfire. During the investigation, the police officer claimed that the victim fired first and that he acted in self-defense. However, according to the process, there were no witnesses who confirmed this version. During the trial, after an interval between 11:55 am and 1:02 pm, debates took place between prosecutor Frederico Joviano dos Santos, head of the 1st Public Prosecutor's Office of Zé Doca, who maintained the accusation, and lawyer José de Alencar Alves, responsible for the defense, who requested recognition of the privileged homicide and the acquittal of the defendant. At the end of the session, the jurors responded, by majority vote, that the materiality and authorship of the crime had been proven. They then recognized the privileged homicide and decided to acquit Hélio de Jesus Lindoso Costa of the charge of qualified homicide.
