Fraud and ideological falsehood: Justice finds plastic surgeon defendant accused of crimes against patients in RS

"There is no way to make many of them today able to look in the mirror. Many of them came here and said: 'I saved up for years and years to have the surgery, it was a dream and today I am shredded, today I can't look in the mirror'. This is the greatest harm to the victims, who have had their self-esteem destroyed", reports Carla Carrion Frós, who works in the coordination of the MPRS Victim Assistance Center. Fuchs will be charged with embezzlement and fraudulent misrepresentation, both with the aggravating factor of having violated professional duty; concussion, on suspicion of demanding undue advantage using public office; and also racial insult with one of the victims. In the complaint, the Public Prosecutor's Office asked for the crime of bodily injury to be closed due to the absence of material evidence, based on the expertise presented by the General Institute of Expertise (IGP). It also argues that the aesthetic result of plastic surgery is dependent on multiple factors and that a bodily injury presupposes the occurrence of violence. "The Public Prosecutor's Office has not filed a complaint, for now, in relation to the crimes of very serious bodily injury, since the result of the reports made by the IGP was that there would be no way to prove that that scar, that that injury was due to the doctor's conduct", explains Carla Carrion Frós. According to Leandro Fuchs' defense, despite being authorized by the courts, he is not practicing his profession. Lawyers say they will prove his innocence. (See note below). The doctor worked at Hospital Ernesto Dornelles, in Porto Alegre, from where he was removed in January 2024. This Monday (3), the hospital highlighted that he is not part of the group (See note below). Regional Council of Medicine of the State of Rio Grande do Sul (Cremers) stated that it opened an investigation, but that the process is being carried out in secrecy. (See note below). The forensic examination has already ruled out the existence of bodily injuries and the Public Prosecutor's Office decided to dismiss it. Dr. Leandro Fuchs has practiced medicine with dignity for more than 20 years, always in compliance with the Code of Medical Ethics and the legislation in force. The investigation lasts another 02 years and is being emptied by the existing expert and documentary evidence. In the end, we are certain that Dr. Leandro Fuchs will be acquitted of all charges." What Cremers says "Cremers was notified and, as happens with all complaints that reach the Council, it opened an inquiry to investigate the facts. Inquiries and ethical processes take place in secrecy by force of law, as provided for in the Code of Ethical-Professional Process." What Hospital Ernesto Dornelles says "Dr. Leandro Fuchs is no longer part of the clinical staff at Hospital Ernesto Dornelles and does not work as a plastic surgeon at the institution.
