Court determines loss of mandate for Manaus councilor Jaildo Oliveira and summons PT substitute

Disclosure/CMM The Amazonas Court determined, in a preliminary decision, the loss of the mandate of councilor Jaildo Oliveira (PV) and ordered the Manaus City Council (CMM) to declare the mandate vacant and summon the substitute. The decision was handed down by judge Aldrin Henrique de Castro Rodrigues, from the 4th Public Finance Court, in a writ of mandamus filed by the Municipal Directorate of the Workers' Party (PT). In the action, the PT claimed that Jaildo Oliveira was definitively sentenced to reimburse the public coffers for irregularities in the use of the Quota for the Exercise of Parliamentary Activities (CEAP) and that the Presidency of the Chamber remained without adopting the measures provided for in the Organic Law of the Municipality after being informed about the final and unappealable decision. The party also argued that the final conviction of the councilor affected his political rights and, therefore, made the loss of his mandate and the summoning of his substitute mandatory. ? According to the party, the councilor's remaining in office prevents the summoning of the party's substitute and compromises party representation in the City Council. The substitute is former councilor Sassá da Construção Civil (PT). When granting the injunction, the judge understood that there are sufficient elements to determine the immediate regularization of the composition of the Legislative House. The decision establishes that the Presidency of the Chamber publishes the declaratory act of vacancy, suspends the exercise of the mandate and future payments linked to the position, summons the legally qualified substitute and proves compliance with the determinations in the process. "As long as the vacancy is not formalized and the substitute is called, the situation identified as illegal is renewed daily, with the parliamentarian's participation in sessions, votes, commissions and other legislative activities, in addition to the perception of subsidies and the maintenance of the contested parliamentary composition", says an excerpt from the decision. The judge also stated that the declaration of vacancy is merely declaratory in nature and does not depend on a vote by the plenary or a new analysis of the judicial conviction. The judge also set a daily fine of R$2,000, limited to 30 days, in case of non-compliance with the decision, in addition to warning that any resistance could result in the determination of administrative, civil and criminal responsibilities. Conviction According to the Federal Public Ministry (MPF), Jaildo used Ceap irregularly between July 2010 and August 2011, during his first term in the legislative house. The expenses included food, fuel, transportation and publicity expenses, which were not proven to be linked to political activity. The councilor was ordered to return R$101,500.00 to public coffers. Even after the final judgment, Jaildo's defense tried to appeal again, but the STJ considered the appeal untenable. The Court reaffirmed the conviction and dismissed the councilor's request.
