The decision is from the 1st Criminal Chamber of the Court of Justice of Minas Gerais (TJMG), which accepted an appeal from the Public Ministry of Minas Gerais (MPMG) and reformed the decision of the District of Inhapim that had revoked the measure. According to the Public Ministry, the case originated from the hiring of buffet, decoration, ceremonial, sound and lighting services for the ceremony. The victim paid R$16,300 in advance, but was informed, on the eve of the wedding, that the services would not be provided. ? It was later found that he resided in Portugal. According to the Public Ministry, international legal cooperation mechanisms were activated, including the Interpol red flag and an extradition request. The MPMG appealed the decision, maintaining that the legal requirements for maintaining the measure remained, especially the risk of escape and the need to guarantee the application of criminal law. When judging the appeal, the 1st Criminal Chamber of the TJMG reestablished preventive detention. According to the ruling, the appointment of a lawyer and the presentation of a power of attorney do not eliminate the history of evasion or the risk of compromising the application of criminal law, since the accused continues to live abroad. The decision also highlights that the location of the person being investigated was only possible through international cooperation mechanisms, a circumstance considered relevant for maintaining preventive detention. The Court also mentioned the existence of information about other demands involving similar facts. With the new decision, the MPMG informed that it will adopt the appropriate measures to request the reactivation of the international extradition procedure, with the aim of enabling the arrest of the accused in Portugal and his handover to the Brazilian authorities to respond to the criminal case in the District of Inhapim.
