SP court rejects action against Alessandro Vieira presented by Moraes' family

The sentence was handed down by judge Fabio de Souza Pimenta, from the 32nd Civil Court of the Central Court of São Paulo. The judge assessed that Vieira's statements, during an interview given to the Sala de Imprensa program, on SBT News, in March this year, were misinterpreted by the authors of the case.

The action was filed by Viviane Barci de Moraes, Giuliana Barci de Moraes and Alexandre Barci de Moraes, who claimed to have been improperly associated with receiving resources from the criminal organization. However, upon examining the full content of the interview, the judge concluded that the senator did not make any statement in this regard.

According to the decision, Alessandro Vieira dealt with information that was being analyzed in investigations related to financial transactions involving Banco Master. During the interview, the parliamentarian also highlighted the need to deepen the investigations before reaching any conclusion.

Another point considered by the Court was the context in which the demonstrations took place. The judge understood that Vieira spoke in his capacity as senator of the Republic and rapporteur of the Parliamentary Commission of Inquiry (CPI) on Organized Crime, establishing a direct relationship between the statements and the exercise of parliamentary activity.

With this understanding, the sentence recognized the incidence of material parliamentary immunity, provided for in the Constitution, which protects deputies and senators for opinions, words and votes related to the performance of their functions.

The judge also stated that he had not identified any intention to offend, defame or slander the family members of minister Alexandre de Moraes. According to the decision, the case resulted from a mistake in the interpretation of the parliamentarian's statements, without there being a direct accusation of the authors' involvement with the PCC.

With the action dismissed, the authors were ordered to pay the procedural costs and legal fees set at 10% of the updated value of the case.

After the decision, Alessandro Vieira stated that the sentence represents a confirmation of the legality of his parliamentary actions.

"The São Paulo Court's decision is a victory for truth and freedom of expression. It confirms that we are on the right path in this fight to transform Brazil into a country where the law applies to everyone. We will continue with courage, technical consistency and respect. That's what the system is afraid of," said the senator.
