According to information from columnist Fábia Oliveira, Furlan was taken away by the police after participants at a party in Pindamonhangaba, in the interior of São Paulo, caught him without clothes in a room with a 5-year-old boy.
In the first interrogation, Furlan claimed that he had drunk alcohol, was feeling ill and went to rest in one of the rooms at the event location. The child allegedly entered the place and he said he mistook her for his own girlfriend.
However, at the custody hearing the actor chose to exercise his constitutional right to remain silent. The Court understood that there were sufficient elements to convert the arrest from flagrant to preventive, keeping the actor detained during investigations.
The child underwent a forensic examination at the Legal Medical Institute (IML). According to the investigation, the report showed injuries compatible with sexual violence.
The case remains under investigation by the Civil Police and is being processed under secrecy as it involves a child.
If convicted of rape of a vulnerable person, Marco Furlan could receive a sentence of up to 40 years in prison if the most serious result provided for in the Penal Code is proven.
