Elan Alencar remains in office until the appeal is judged by the TSE. Councilor Elan Alencar's revocation of mandate was maintained after the Court denied the appeal. By admitting the special appeal, the president of TRE-AM understood that the defense presented issues that must be analyzed by the TSE, such as the allegation of omission in the judgment of the motions for clarification and the discussion about the legal framework adopted to characterize fraud regarding the gender quota. In the embargo, the author of the action asked for the decision to be reviewed and argued that a subsequent decision by the TSE would remove the suspensive effect. The judge rejected the request and stated that the higher court's decision did not revoke or suspend the act of the TRE-AM Presidency. On June 19 of this year, TRE-AM unanimously rejected the embargoes for declaration presented by Elan Alencar and maintained the decision that annulled the registration of Democracia Cristã and the diplomas of the candidates elected by the party in the 2024 municipal elections. At the time, the court understood that the embargoes could not be used to re-discuss the merits of the case or to re-evaluate the evidence. As a result, the understanding that there was fraud in the gender quota in the composition of the party's proportional ticket was maintained and the immediate execution of the ruling was determined.
