TCE-AM suspends Aadesam's R$15.2 million tender due to suspected irregularities

Disclosure The Court of Auditors of the State of Amazonas (TCE-AM) suspended a tender worth R$ 15.2 million from the Amazon Agency for Economic, Social and Environmental Development (Aadesam). The process included hiring a company to provide air, river and land tickets for travel within and outside the country. The decision was published on Friday (3). The suspension was determined by advisor Mário José de Moraes Costa Filho following a complaint filed by a company interested in participating in the bidding. According to the court, changes made to the notice may have harmed competition between participants. One of the irregularities highlighted was the change in technical requirements for companies on the eve of the opening of trading, scheduled for June 25th. According to TCE-AM, the change occurred without the bidding deadline being reopened and without defining a new date for the dispute. ? For TCE-AM, the changes should have been formalized and disclosed again to participants.

Another point highlighted in the decision was the removal of an item from the Terms of Reference that defined how the contracted services should be performed. According to the court, the exclusion was only communicated in a response to questions asked during the bidding. "Even more seriously, both conducts — the late errata and the suppression of item 7 of the TR in response to clarification — appear to have been conducted outside of item 12.5 of the notice itself, which establishes, without reservations, that, once the objection was accepted, a new date would be defined and published for the holding of the event", states an excerpt from the decision. By suspending the bidding, the counselor considered that the process could advance to the next stages and even result in the signing of contracts before the case analysis was concluded. According to him, this could make it difficult to correct the process if the irregularities were confirmed. With the decision, the bidding is paralyzed until further analysis by the Court of Auditors. The signing of contracts related to the process is also prohibited. TCE-AM also determined that Aadesam and the auctioneer responsible for the bidding should present clarifications on the points highlighted in the complaint. The case will continue to be analyzed by the technical sectors of the court and by the Public Ministry of Accounts of Amazonas. g1 sought out the Government of Amazonas to comment on the irregularities highlighted by the Court of Auditors, but did not receive a response until the last update of this report.
