The Federal Highway Police (PRF), however, disputes this version and states that the records analyzed show that the truck made a brief stop after the accident, continued its journey, passed in front of the corporation station without stopping and the driver did not call the emergency telephone number 191. In an interview with Rede Vanguarda, the truck driver's lawyer, Antônio Franc, stated that the driver told a dealership employee that he would go to a safe place to park the truck, as the stretch of Via Dutra was under construction and an immediate stop could block the road. According to the defense, the truck driver noticed that the elderly woman was outside the vehicle, apparently uninjured, talking on her cell phone and taking photographs of the truck. After that, he went to a gas station, where he waited for around two hours to register the incident. The lawyer also stated that, for safety reasons, the driver could not open the trailer door on that stretch of highway and, therefore, decided to continue to a place considered safe to stop.
