Minister Gilmar Mendes, however, understood that accepting the request would require re-examining the facts and evidence of the process, which is not allowed in an extraordinary appeal. He also stated that any offense to the Constitution would be indirect, which prevents the Court from analyzing the appeal. With the decision, the ruling determined by the 3rd Panel of Criminal Law of the TJPA remains valid, which concluded that there was sufficient evidence for Victor Hugo dos Reis Morais to be tried by the Jury Court for the crimes of qualified intentional homicide, through an appeal that made the victim's defense difficult or impossible, and attempted intentional homicide.
