In the decision, the judge explained that Roberto Peixoto was under house arrest under habeas corpus, granted until a medical examination was carried out to verify whether his state of health was incompatible with serving his sentence in a closed regime. In a statement, Roberto Peixoto's defense confirmed the arrest and reported that it respects the decision of the Criminal Executions Court, but disagrees with it. According to lawyers, Peixoto faces serious health problems and does not have adequate cognitive conditions. The defense also stated that it will adopt the appropriate legal measures, based on the principle of human dignity. The case Roberto Peixoto and his wife, Luciana Flores Peixoto, were convicted by the Federal Court of money laundering. According to the process, the crimes involved the concealment of assets through the acquisition of properties between 2005 and 2007. The former mayor was sentenced to 10 years and 6 months in prison, in an initial closed regime, while Luciana received a sentence of 6 years, 8 months and 30 days in prison, in an initial semi-open regime. In August 2024, after the conviction became final, Roberto Peixoto was arrested, but, after a custody hearing, the Court authorized him to leave prison and wait at home for the analysis of the request to serve his sentence at home.
