Drunk driver who ran over and killed motorcyclist gets more than 14 years in prison in Acre After more than two years, Francisco Alves Moreira da Silva was sentenced to more than 14 years in prison for running over and killing Welisson Araujo dos Santos, injuring Dhayvid da Silva Jesus and driving while intoxicated. The accident occurred in December 2023 in Vila do Incra, in the municipality of Porto Acre, in the interior of the state of Acre. With the decision, the Court ordered an arrest warrant to be issued so that Francisco could begin serving his sentence in prison. According to the sentence, the driver is responsible for qualified homicide by cruel means while driving while intoxicated, bodily injury, drunk driving and violating the suspension of the right to drive. He was driving drunk and had his National Driving License (CNH) suspended when the accident occurred. During the trial, the Public Prosecutor's Office of Acre (MP-AC) highlighted that the evidence showed that the accused took the risk of causing death by driving drunk, with a suspended driver's license and disregarding the right of way in traffic. This understanding was accepted by the Court at the stage in which the case was sent for trial by the Jury Court. Afterwards, the thesis was also confirmed by the jurors. Accident The accident occurred at around 3:45 pm on December 20th. Francisco Alves Moreira da Silva, who was 59 years old at the time, hit the vehicle in which Dhayvid da Silva Jesus and passenger Welisson Araujo dos Santos were traveling. Welisson was seriously injured and was taken to the Rio Branco Emergency Room, but died hours later in the health unit. The driver of the motorcycle was not injured and preferred not to seek medical attention. Suddenly, he took off with the car, went over the curb and crossed Avenida João Barbudo, at which point he hit the motorcycle. The motorcyclist tried to brake, but was unable to avoid the collision.
