The judge also mentions statements from witnesses and police officers who reported signs of drunkenness, in addition to information that the accused had tried to leave the scene after the accident. According to the decision, although the driver refused to take the breathalyzer test, the witness reports, combined with the presence of alcoholic beverages in the vehicle and the circumstances of the accident, are sufficient, at this stage of the process, to justify the analysis of the hypothesis of possible intent. The judge also highlighted that the understanding of the Federal Supreme Court (STF) and the Superior Court of Justice (STJ) allows cases of traffic homicide to be submitted to the Jury Court when there is evidence that the driver assumed the risk of producing the result, such as in situations involving drunkenness, driving on the wrong side of the road and other extremely dangerous conduct. With the decision, the case will be referred to one of the Manaus Jury Courts, which will continue the criminal action.
