“There is the possibility of using United States military force on Brazilian territory,” warns the most recent document, sent on July 1 and signed by the Minister of Foreign Affairs, Mauro Vieira, in response to a request for information from Congressman Evair Vieira de Melo (Republicanos-ES).
In the text sent to Congress, the chancellor states that the classification can generate relevant impacts for the economy and national sovereignty. According to him, US authorities could apply administrative and judicial measures of a unilateral and extraterritorial nature against Brazilian people, companies and organizations.
In May, the US classified the PCC and CV criminal factions as terrorist organizations. Last week, that country's Treasury Department sanctioned two people and three Brazilian companies, accusing them of alleged ties to the PCC.
Still in his response to deputy Evair Vieira, the minister reinforced that "the unilateral classification could be invoked as a justification for extraterritorial actions against Brazilian institutions, particularly in the financial, migratory and criminal spheres. There is, furthermore, the risk of using US military force against the national territory", reiterates the minister.
Mauro Vieira highlighted in his response that there was no formal communication from the United States to Brazil about the intention to designate Brazilian criminal factions as terrorists. He also considers that this classification does not present benefits for the security of countries.
“Militarize agenda”
In addition to the last response, the minister had already drawn attention to the risk of use of military force by the US in Brazilian territory in a document dated May 29 of this year, addressed to deputy Captain Alberto Neto (PL-AM), who also submitted a request for information to Itamaraty on the topic.
“On a strategic and economic level, such reclassification would tend to militarize the regional agenda to combat organized crime, increase compliance costs for companies and the national financial system and penalize lawful activities,” he stated.

The chancellor highlighted that given the breadth of terms applied in US counterterrorism legislation, there could be serious implications for Brazilian citizens in the financial, migratory and criminal areas, in addition to the potential use of military force. “This is, therefore, a measure that has relevant impacts on Brazil’s sovereignty.”
The minister assesses that, in addition to not generating concrete benefits, the classification of factions as terrorists could harm cooperation between police forces in both countries, “by introducing confusion between two clearly different phenomena in the light of Brazilian legislation: organized crime and terrorism”.
