The decision considered that there are still doubts about the inheritance, including the number of heirs, the validity of any will, the existence of debts and the division of the assets. According to the decision, the death of the author transfers the rights to the successors, but does not allow each one to withdraw amounts individually before sharing.
The court understood that the lack of consensus between those involved and the need to define the total inheritance assets prevent the early release of resources.
Since he died, in 2019, at the age of 88, his three children - João Marcelo, from his marriage to Astrud Gilberto, Bebel, from his marriage to Miúcha, and the youngest Luísa Carolina, from his relationship with Claudia Faissol - have been fighting with each other and also with Maria do Céu Harris, who says she lived in a stable union with João Gilberto for 35 years, from 1984 to 2019.
In 2023, singer Bebel Gilberto, daughter of João Gilberto, reached a court agreement in which she recognized the "uninterrupted stable union between her late father" and Mozambican Maria do Céu.
In 2024, businesswoman Claudia Faissol, mother of Luísa, the singer's youngest daughter, asked the court to recognize her stable union with João Gilberto.
