PGR exchanges Buzzi's compulsory retirement request for dismissal from the STJ

Deputy Attorney General of the Republic José Adonis spoke during the session taking place at the STJ behind closed doors. The ministers began debating the case at 9:15 am and are expected to conclude the judgment around 4 pm.

The change in the line adopted by the PGR was made based on the new understanding of the Federal Supreme Court (STF) that the maximum punishment in administrative proceedings in the Judiciary should be removal from office, without payment of salaries. The new rule was made official this week by the National Council of Justice (CNJ), which also judges disciplinary cases against magistrates.

There are, however, members of the STJ who consider that the case against Buzzi was opened before the rule change. Therefore, the expectation is that part of the court will defend the colleague's compulsory retirement. In this scenario, the minister would no longer perform his duties, but would receive salaries proportional to his working time.

The STJ is made up of 33 ministers. Today there is an open position. Buzzi himself is at the session, but will not vote. Three other ministers will not vote because they claimed health issues and impediment. Therefore, 28 votes will be cast.

Buzzi denies the accusations and added an erectile dysfunction report to the case, in an attempt to convince the other members of the Court that he would not be physically capable of carrying out the crimes for which he is accused.

At the beginning of the session, Minister Luís Felipe Salomão, rapporteur of the case, read a summary of the investigations. In addition to the PGR representative, the complainants' lawyers also spoke. After the debates, voting will begin.

In addition to the administrative process at the STJ, Buzzi is also responsible for misconduct at the CNJ and a criminal investigation before the STF. All investigations are confidential.
