In 2021, after suffering domestic violence, the victim obtained an urgent protective measure against her husband. The court decision ordered his removal from the house where they lived. "I had asked for help a long time ago. I asked for a measure against my husband, who was an alcoholic, and with this protection he went there and ordered the power to be turned off so he could see me leaving the house. But I didn't leave. I lived all this time with my autistic son without energy. The situation began to change at the end of May this year. During a hearing held in a criminal action filed by the Public Prosecutor's Office against the victim's in-laws for psychological violence, she described in detail the difficulties she had faced over the last few years. The testimony revealed a situation that went beyond property conflicts and highlighted a serious violation of the fundamental rights of the victim and her son.
Upon analyzing the request, the Judiciary determined the immediate restoration of electricity. The Santa Catarina Court also prohibited any act that prevents or hinders the provision of service to the residence.
In the request presented to the Judiciary, the Public Prosecutor's Office maintained that the prolonged deprivation of electricity and the obstacles imposed to prevent the restoration of the service constituted a continuous form of psychological violence against women.
The decision was fulfilled on June 18. "It seemed like it was a lie. When we saw the truck there, it didn't even seem true. My mother and sister came running, celebrating. We said: 'What a blessing, what a blessing'. There's no explanation. I don't want anyone to go through this. I'm very happy," said the woman, emotionally.
A criminal action filed by the MPSC against the victim's in-laws for psychological violence is ongoing. In addition, there is also an adverse possession action filed by the woman, privately, to recognize the property where she has lived for more than 20 years. Recently, the court granted the author's appeal and recognized the victim's ownership of the house. The decision has not yet become final.
