According to two court magistrates and interlocutors of two others, Marçal's ineligibility is blatant and prevents him from contesting the election. The plenary trial should only take place at the beginning of September, due to the TSE's legal deadlines.

Some TSE ministers, however, believe there is bad faith in the candidacy request. The reading is that the influencer knows he is ineligible, but wants to use the period between registration and the TSE's denial to campaign and achieve greater personal and professional projection.
A person close to the case's rapporteur, minister Estela Aranha, told Folha that Marçal's stance must be taken seriously, as it appears to have been designed to create confusion among voters. Another interlocutor assesses that the damage could worsen if the businessman manages, for example, to participate in debates on TV.
As Folha de S.Paulo showed, anyone with a party affiliation can request registration, even if they do not meet the requirements to do so. Verification of the eligibility criteria is the responsibility of the Electoral Court, when judging whether or not to accept a given candidacy.
Therefore, until there is a definitive decision from the TSE rejecting Marçal's candidacy, the influencer is in the running for President and can campaign, including using resources from the electoral fund.
Marçal was sentenced to ineligibility by the TRE-SP (Regional Electoral Court of São Paulo) for abuse of the media, due to the "cutting championship" of videos for the internet that he promoted among his followers during the 2024 campaign, when he ran for Mayor of São Paulo.
Folha de S.Paulo sought Marçal's advice, but has not yet received a response. The influencer said, on Monday (17), in a hearing promoted by the Brasil Paralelo channel, that he intends to participate in the debates and that he "will not create problems" for the candidacy of Flávio Bolsonaro (PL).
