The Court of Justice of Mato Grosso (TJ-MT) ordered the release of lawyer Ederson Umbelino Nery, accused of attempted murder and theft after a traffic accident that occurred in Rondonópolis, in 2025.

The decision was signed by judge Gabriela Knaul Albuquerque, from the Fourth Criminal Chamber, and published this week, following an appeal filed by Ederson's defense.

The lawyer had been in prison since August last year, suspected of stabbing a driver in the neck, attacking his wife and stealing her motorcycle to flee the scene.

He has already been sentenced to be tried by the Jury Court, with a session scheduled for August 27th.

In the appeal, the defense claimed that the lawyer's father has a delicate health condition and is admitted to an Intensive Care Unit (ICU). It was also pointed out that Ederson has a serious health condition and has been diagnosed with appendicitis.

Another argument presented by the defense was the alleged illegal constraint due to the excessive period of time for the formation of guilt, in addition to the allegation of bias on the part of the magistrate and the police chief responsible for the case.

When analyzing the case, the judge highlighted that Ederson has already been sentenced to answer for the crimes and rejected the arguments presented by the defense related to excessive time.

The judge also highlighted that no medical reports capable of proving the accused's delicate health condition were presented.

On the other hand, the judge accepted the request to replace the prison with alternative precautionary measures, based on humanitarian grounds related to the situation of the lawyer's father.

“In this hypothesis, the patient’s favorable personal predicates, associated with humanitarian elements related to the state of health of his parent, suggest the appropriateness of replacing prison with less serious measures”, says an excerpt from the decision.

According to the decision, the lawyer will be monitored by an electronic ankle monitor.

He is also prohibited from contacting the victims and from being absent from the district, in addition to being obliged to attend appointments related to the process, such as the Jury Court session.
