What not everyone knows is that each infraction can be contested free of charge. However, the right depends on compliance with the deadlines set out in the legislation. According to lawyer Thalita Lima, the Brazilian Traffic Code (CTB) guarantees every driver the right to contradictory and full defense. The driver can contest the fine when he considers that it was applied incorrectly or presents some irregularity. "In these cases, among the most common errors are incorrect information about the vehicle's license plate or characteristics, incomplete identification of the location or date of the infraction, failures to identify the issuing agent and the absence of mandatory data provided for in the Brazilian Traffic Code", he explains. Data from the State Department of Traffic of Amapá (Detran-AP) show that only 386 defenses were filed between January and June, compared to almost 7 thousand notifications issued in the first half of the year. The body sends the penalty notice and opens a new period of 30 days for appeal to the Administrative Board of Infractions Appeals (Jari), responsible for judging these cases. To contest the fine, the driver must present copies of their ID, CPF, National Driving License (CNH), vehicle document, notification received and form available on the Detran-AP website. Additionally, you can attach photos, videos or any document that proves the version presented. "An appeal should not be limited to the allegation that the driver does not agree with the fine. It is necessary to demonstrate, based on the legislation and the evidence presented, why that fine deserves to be reviewed", says Lima. Detran accepts appeals via email, with a completed form and attached documentation. Still, the agency recommends in-person delivery. Those who prefer can also send the documents by post. There is no fee charged in any of the modalities. The body's main guidance is to observe the date indicated in the notification.
