Illiterate father is tricked into signing alimony agreement A 44-year-old illiterate man was tricked into signing, with his fingerprint, a child support agreement that contained an amount four times greater than what was previously agreed. The case ended up at the Public Defender's Office of the State of Paraná (DPE-PR), which managed to suspend the document in court. According to the agency, the man is a construction worker. In the agreement, he and his wife agreed to a pension of R$400 per month. However, because he could not read, the man did not know that the document he signed mentioned values outside the verbal agreement: the delivery of his food voucher card, worth R$955, in addition to a direct payroll deduction worth R$800. In the end, the pension rose to R$1,755 and the man was left with R$800 to get through the month, "an insufficient amount to guarantee essential expenses, such as housing and food, for his current wife and his another child", according to the Public Defender's Office. ? "The agreement was signed at the pregnant woman's residence. Her lawyer was not present at the time of signing, nor were there any witnesses. The person assisted informed that he attended the location because the opposing party was in possession of his identity document (RG) and conditioned its return on the signing of the agreement. Thus, only the parties were present at the act", explains the DPE-PR. The body also claims that the Court made a mistake in approving the agreement. "There was a mistake in the approval of the agreement, since, in the case of an illiterate person, the legislation requires the observance of specific formalities. [...] The legislation requires that, when an illiterate person signs a contract, this must be done through a 'signature by request', that is, when a third person signs at their request, necessarily in the presence of two witnesses. This essential formality was not complied with", explained Jeane Gazaro Martello, public defender responsible for the case. g1 questioned the Court of Justice of the State of Paraná (TJ-PR) about the error in approving the agreement, but, in a note, the communications department said that "as it is a judicial decision, it does not issue notes or comments about it". According to the Public Defender's Office, the man did not want to act criminally against the woman, but asked that the amount stop being deducted. The decision highlighted that the absence of a signature in accordance with the law and the lack of an identification document in the process invalidated the man's expression of will. "With the decision, the effects of the agreement were immediately suspended. The Court ordered the issuing of a letter to the employing company to stop payroll deductions and the transfer of food vouchers, ensuring that the benefit returns to the worker. In addition to stopping the immediate loss, DPE-PR also requests that, at the end of the process, all amounts unduly paid be refunded to the construction worker", states the Defender's Office.
