The decision is the result of a Public Civil Action filed on January 22 by public prosecutor Samira Mercês dos Santos, who, at the time, was responsible for the 1st Public Prosecutor's Office of Pinheiro.

According to the MPMA, the action was motivated by complaints from candidates about alleged illegalities in the organization and conduct of the competition. According to the MPMA, the City of Pinheiro attempted to fund the competition only with the amounts collected through registration fees, without budget allocation provision and without observing the rules of the Federal Audit Court (TCU) related to the public spending limit. The body also pointed out that vacancies were offered for positions that had no legal provision for creation within the municipality. Another irregularity cited was the lack of publicity regarding the composition of the committee responsible for overseeing the competition. Also according to the Public Ministry, appeals presented by candidates were rejected by Funatec with generic justifications and without technical or academic grounds. The MPMA also stated that the Municipality and the foundation arbitrarily changed the competition schedule. The publication of the preliminary results of the objective tests was postponed without explanation until a date after the municipal elections. According to the organization, the change indicated a possible political maneuver to reduce electoral erosion and disrupt the government transition.
