According to police, Samylle had been living with her aunt and uncle for at least two months. During this period, custody of Samylle was transferred between family members until the girl began to temporarily live with her aunt. On December 2, 2025, the agreement was approved, and custody of Samylle was returned to her mother, with the possibility of visits from her father. From that moment on, the girl stopped living with her older sister, who is also a child. In July 2026, Samylle's aunt approached the Guardianship Council of the 3rd Region. She reported that the child's mother was facing a health problem. The aunt then became provisionally responsible for Samylle through a term. The change was not the result of a custody court decision. According to the mother's defense, the aunt did not allow her to visit or maintain contact with her daughter. The child's father also stated that he was prevented from seeing her. Delegate Alice Fernandes stated that the aunt has collaborated with the investigation and appeared to give a statement every time she was called. To date, she is considered a witness. On August 9, during a Father's Day gathering, the maternal grandparents noticed injuries on the girl's body. They received information that the marks had been caused by a fall. Four days later, on August 13, the aunt contacted the Public Defender's Office. She was instructed to gather documents to file a permanent custody action, but did not return to present them. On August 17, Samylle was taken by her aunt and uncle to the Bom Jesus Emergency Care Unit, in the East Zone of Porto Alegre. The child arrived at the scene already dead.
