Understand the dispute
The Abravanel family's defense does not dispute the need to pay the tax, but questions the calculated amount. According to the process, the lawyers claimed that there are no specific rules for assets held abroad and stated that a debt of R$10,307,491.04 left by Silvio Santos would also not have been considered.
Judge Márcio Ferraz Nunes initially authorized the suspension of the collection of a difference of just over R$17 million. The decision allowed the judicial deposit of R$ 17,610,213.38, suspending the enforceability of the tax credit related to the assets covered by the amount until there is a definition of the amount actually owed.
The Attorney General of the State of São Paulo contested the arguments presented by the family. According to the agency, in the absence of a specific complementary law for inheritance of assets abroad, the calculation must consider the state where the owner of the assets resided or was domiciled in Brazil.
The Prosecutor's Office also requested an investigation into Silvio Santos' debt used by the defense to request a tax deduction. In December last year, the Court ordered a new expert to analyze accounts, assets and companies linked to the businessman and define the tax amount.
Goods abroad
Among the assets left by Silvio Santos are a stake in Daparris Corp Ltd., located in the Bahamas Islands, in addition to two accounts at Banco Suntrust and Citibank, in the United States, which totaled R$429,947,843.54.
Before dying, in August 2024, at the age of 93, Silvio Santos had organized the family business succession and distributed part of the inheritance among his daughters. Silvia's statement, however, does not clarify the amounts received nor whether the entire sharing was completed. There is also no indication of her possible ownership interest in SBT.
