PF will investigate signs of crimes in the allocation of Pix amendments, decides Dino

Dino's decision was taken after receiving a technical report from the Federal Audit Court (TCU), sent to the STF on July 31, which identified irregularities in the allocation of resources and possible damage to public coffers.

According to the TCU, the inspection of 100 Pix amendments, totaling R$198.1 million allocated to 74 municipalities, identified four groups of irregularities: failures in transparency and traceability of resources, problems in financial execution, fraud and improprieties in bidding and irregularities in the execution of contracts and works.

Among the cases highlighted by the TCU are movement of resources in non-specific accounts, payments without proof, expenses unrelated to the purpose of the amendments, allegedly fraudulent bids, hiring of unreputable companies, overpricing and non-execution of works, with losses to the treasury exceeding R$55 million.

"In addition to the concrete irregularities in the application of resources, the Report identified structural weaknesses in Transferegov.br itself, consisting of the acceptance of generic information (lack of details of the object) in the work plan; unrestricted alteration of objects, values and goals in the work plans; and outdated bank balances that lead to mistakes", points out Dino in the order.

'State of unconstitutionality'

Flávio Dino, since taking office at the Supreme Court two years ago, has led an offensive to increase transparency and traceability of parliamentary amendments. In the decision, he stated that a "state of unconstitutionality" persists in the execution of the resources.

"However, despite the adoption of such measures, the data presented by the TCU, in a Technical Report sent on 07/31/2026, demonstrate the persistence of a state of unconstitutionality, which justifies the need to adopt new measures to conform the execution of 'individual amendments' to the constitutional parameters of transparency and traceability."

In the decision, Dino ordered the TCU audit report to be sent to the General Directorate of the Federal Police to verify the existence of signs of crimes related to the execution of the Pix amendments.

If the suspicions are confirmed, the PF must attach the material to ongoing investigations or open new investigations, with priority given to cases in which the TCU has identified losses to public coffers.

Dino also gave ten working days for the Ministry of Management and Innovation in Public Services to inform the measures adopted to correct the flaws in the Transferegov.br platform, identified by the TCU as one of the factors that compromise the transparency and traceability of amendments.

The minister also determined that States, the Federal District and municipalities will adopt, in the 2027 budget laws, a standardized system for identifying parliamentary amendments, with the aim of increasing transparency and traceability of resources.

Explanations from PT deputy

Dino gave ten days for federal deputy Lindbergh Farias (PT-RJ) and the Chamber of Deputies to comment on news that resources from amendments authored by him destined for the Food Acquisition Program (PAA) had been used to purchase products from cooperatives in a state other than the one for which he was elected.

Estadão asked for a statement from the PT member about Dino's determination. According to the decision, both the parliamentarian and the National Supply Company (Conab) state that the selection of suppliers followed "technical criteria" and that the food was intended for the population of the State originally benefiting from the program.

To the Chamber and the Senate, Dino ordered the presentation of a joint statement on Axes 1 and 2 of the Joint Work Plan. The Houses must explain the methodology adopted, "clarify the divergences identified in the data on the rapporteur's amendments", indicate which information should prevail for "traceability purposes" and inform, by financial year and type of amendment, the quantity and values ??of the commitments.
