According to the police report, the woman left her daughter in the care of her husband while she worked. When he returned from the corridor, he heard him cursing the girl. She says she entered the apartment and questioned her husband's behavior, stating that she could not treat her daughter that way.
The woman reported that during the argument she pushed her husband and he fought back. She would have pushed him again causing him to fall on the bed. The lawyer then stated that he would leave home. He opened the closet and started taking out his clothes, putting them in a suitcase.
The superintendent called and announced that the police had been called. The woman took the child and went to the apartment manager's apartment, according to police records.
The man was alone in the apartment when the police arrived. The woman opened the door and allowed the agents to enter. The lawyer was locked in the room and refused to come out. The Gate (Special Tactical Actions Group) was requested and, even after the room door was broken down, it took more than two hours of negotiation before he surrendered.
The lawyer said, according to police records, that the girl was under his care, but in the afternoon she went to meet a friend at the condominium. At one point, the child was in the hall and he was gone. When he returned to the building, he did not find his daughter, and became desperate.
The father stated that he may have been "a little harsh" with the child and said he did not remember attacking him. He also denied having assaulted his wife. The lawyer stated that he was "95% sure" that he did not touch her, and that there was only a verbal argument. He added that he had drunk alcohol and did not fully remember everything that happened that day.
The woman stated that the lawyer has been showing depressive behavior.
He was arrested red-handed for child abuse and the case was registered at the 4th DDM (Women's Defense Police Station). In a custody hearing on Friday afternoon (21), the arrest was converted into preventive arrest (without a deadline) by the TJ-SP (Court of Justice of the State of São Paulo).
