In disability benefits, the institute uses medical expertise to assess whether the insured still has impediments that make it impossible to return to the job market. The analysis mainly considers the impact of the condition on professional capacity and the possibility of rehabilitation. Therefore, the mere existence of a previous illness does not guarantee continuity of the benefit.

Who can be dismissed

Social security legislation establishes some protections. Insured people who have already turned 60 and those aged 55 or over who have received at least 15 years of disability benefits, considering temporary assistance and permanent retirement, are exempt from periodic review examinations.

Even in these cases, expertise may be requested to analyze a request for an additional 25% due to the need for permanent assistance, to investigate suspected fraud or when there is a request from the beneficiary himself. The STF also defined that the INSS can administratively review benefits granted by the Court, as long as due legal process is respected.

Attention to BPC

Anyone who receives the Continuous Payment Benefit (BPC) needs to pay attention to the Single Registry. The 2026 Registration Qualification Action requires families with outdated information to regularize their data within the specified deadline.

In this case, the suspension does not occur due to medical expertise, but due to the lack of updating family information. Official notices can arrive via the Cadastro Único application, letters or payment statements.

How to avoid problems

Ignoring an official summons may lead to suspension of the benefit. Therefore, anyone called for forensic examination must keep up-to-date documents, including photo identification and CPF, recent medical reports, exams, hospitalization reports, prescriptions and records on clinical evolution and functional limitations.

Keeping the medical record organized helps the insured person present the necessary information to the expert to demonstrate that the condition that underlies the benefit is still present. It is also important to regularly monitor the situation on official INSS channels.
