She reported that the child's mother was facing a health problem. The aunt then became provisionally responsible for Samylle through a term. The change was not the result of a court custody decision. According to the mother's defense, the aunt did not allow her to visit or maintain contact with her daughter. The child's father also stated that he was prevented from seeing her. On August 9, during a Father's Day gathering, the maternal grandparents noticed injuries on the girl's body. They received information that the marks had been caused by a fall. Four days later, on August 13, the aunt contacted the Public Defender's Office. She was instructed to gather documents to file a permanent custody action, but did not return to present them. On August 17, Samylle was taken by her aunt and uncle to the Bom Jesus Emergency Care Unit, in the East Zone of Porto Alegre. The child arrived at the scene already dead. On August 20, Nicolas Gabriel Almeida Staubus, 22 years old, Samylle's uncle, was arrested preventively. In his statement, Nicolas stated that he gave "a spank with the intention of correcting the girl's bottom because she pooped in her pants", according to the police chief, but the police claim that this version is not compatible with the marks on the body.
