She stated that the equipment had had a problem for months and that a part did not attach correctly. The witness also said that the student was doing the exercise correctly at the time of the accident. The court also pointed out that the gym did not present documents proving periodic maintenance of the equipment. For the court, the company was unable to prove that the student was at fault for the accident.
