The Federal Audit Court (TCU) decided this Wednesday (15) to allow the salary and bonus for performing the role of head of employees of the court itself, the Chamber of Deputies and the Federal Senate to be considered separately. This means that employees who already receive the constitutional ceiling will, in practice, be able to receive the full value of the benefit, without deductions. The civil service ceiling corresponds to the remuneration of ministers of the Federal Supreme Court (STF), currently at R$46,366.19. The Federal Constitution says that remuneration funds, that is, those paid on account of the work carried out by the public agent, must be subject to the ceiling. Still according to these rules, if their sum exceeds the limit established by the ceiling, the surplus must be cut. The so-called “ceiling abatement” is carried out. Other examples of remuneration funds are overtime and nighttime pay. The decision was taken by eight votes to one. The rapporteur, minister Walton Alencar Rodrigues, voted for the TCU not to analyze the request made by Sindilegis, a union that represents Legislative and court employees. According to him, the entity would not have the legitimacy to present the representation. The president of the TCU and reviewer of the action, minister Vital do Rêgo, opened a disagreement and defended that the case be analyzed. For him, the current rule discourages employees from taking on leadership roles, because part of the bonus ends up being reduced by the ceiling. The other ministers followed the divergence.
