(FOLHAPRESS) - The MPPR (Public Ministry of Paraná) charged, this Tuesday (18), a doctor with the death of six children in the pediatric ICU of the private hospital Angelina Caron, in Campina Grande do Sul, 20 kilometers from Curitiba. When asked to clarify when and how it identified the contamination and the responsibility of the doctor reported, the Angelina Caron hospital said, in a statement, that it did not receive an official summons regarding the process or the contents of the files. Therefore, he stated that it was not possible to speak out.

As soon as it is officially cited, the hospital states that it will provide clarifications within the legal deadlines and provide the necessary documents to investigate the facts.

The professional was technical director of the hospital's pediatric unit and, according to the accusation, acted with "serious negligence" by failing to monitor and apply basic asepsis and biosafety protocols.

"It allowed an environment of cross-contamination to emerge through unacceptable practices, such as the reuse of gloves in procedures between different patients, lack of bathing, inadequate handling of intubations and venous access and also of children's diapers", said prosecutor Éder Teodorovicz.

The complaint was filed last Friday (14) and received by the Court on Monday (17), according to the MPPR.

The liability presented by the MPPR is for culpable homicide, when there is no intention to kill.

"If they prove that there was in fact a failure to follow the correct procedures, be it hygiene, cleaning and the like, the sentence, for each homicide, can vary from 1 year and 4 months to 4 years, with the possibility of an increase of a third", says lawyer Gabriel Bergamo, specialist in health law at the firm Gabriel Bergamo Advocacia, in Curitiba.

In addition to the criminal accusation, the Public Ministry requested that a minimum compensation amount of R$50,000 be set for each of the six affected families.

According to Bergamo, the Angelina Caron hospital may also be held responsible for the deaths in the civil sphere, depending on the investigation of the circumstances of the case. In case of conviction, the hospital may have to pay financial compensation to the families.

"For this not to happen, the hospital would have to prove that it followed all cleaning, hygiene and inspection protocols correctly", he states.

In a note to Folha de S.Paulo, the institution stated that it maintained its "commitment to patient safety, compliance with technical, health and care standards and collaboration with the competent authorities".

According to information published on the official website, the hospital has been operating for 40 years and has more than 2,000 employees, including 350 doctors in 30 specialties, in addition to medium and high complexity services.

The institution claims to perform around 1 million procedures per year. In 2025, more than 128 thousand patients were treated at the hospital.

On August 8, Health Minister Alexandre Padilha visited the hospital during the federal government's agenda in Paraná.
