Dentist had already accused businessman of marital rape before assault

In May of this year, Giulia went to the 2nd DDM (Women's Defense Police Station), where she reported the episodes of sexual violence. The Civil Police opened an investigation to investigate the case, which is still under investigation.

The accusation comes before the episode of domestic violence that occurred in the early hours of Saturday (15), in Pinheiros, in the west of São Paulo, which led to the businessman's preventive arrest (without a deadline).

Kos is suspected in this second case of attacking the dentist with punches and a baseball bat and threatening her with a stun gun.

The businessman denied the attacks that occurred on Saturday to the police and stated that he was attacked by his wife during an argument. Davi Gebara, Kos' lawyer, told Folha de S.Paulo that he will not comment on the rape accusation.

Giulia claims that the episodes of violence began even before the wedding. She said she stayed in the relationship because she believed the problems could be overcome and that the family would be preserved.

"I was always stubborn, I believed in the power of family and everything would work itself out," she said.

The dentist said that Kos had physically attacked her on other occasions, but that, on previous occasions, he had been careful not to leave visible marks. According to her, the businessman used to deny the attacks and then tried to reconcile.

Regarding the episodes of sexual violence, Giulia stated that they occurred during the marriage and that some of them occurred during periods in which, according to her, Kos was facing problems related to alcohol consumption.

"I was sleeping peacefully and I woke up with him on top of me or inside me. I asked him to leave, I asked him to stop, and that didn't happen," he said.

The dentist stated that it took her a while to understand that sexual relations without consent within marriage could constitute sexual violence.

"I kept this for a long time, because it is a very embarrassing situation and because I thought that, because he was my husband, he would have that right," she said.

Giulia said she decided to report the episodes when she intended to separate. At that moment, he stated, he began researching the subject and began to understand in a different way what had happened during the relationship.

"I started to research more about what it was about, because I wasn't yet aware that this was a very serious crime. I said: 'Wow, this happens to me'", he said.

RECONCILIATION

After registration, Giulia and Kos resumed their relationship. Fábio Fajolli, a lawyer representing the dentist, states that the two even traveled together after their reconciliation.

For Fajolli, the resumption of relationships after episodes of violence is a recurring situation and does not mean, in itself, that the facts previously reported no longer exist.

“This is very common in couples,” he said.

The lawyer said that, at the time, he questioned Giulia about the decision to resume the relationship, but he respected her choice.

"I even said: 'Are you sure?'. I have experience, I know how it works. She said: 'No, we're doing really well'. And I need to respect her wishes," said Fajolli.

The couple was back together when Saturday's episode occurred. Giulia told Folha de S.Paulo that she had lived with Kos for almost a year and that, despite other arguments during that period, the relationship was calmer than before.

In the early hours of Saturday, however, she claims that she was attacked while returning from dinner. The dentist reported being punched inside the car and, later, being hit with a baseball bat and threatened with a stun gun.

Kos presented another version to the police. He denied having assaulted the woman inside the vehicle and stated that Giulia began attacking him with punches and kicks. The two had apparent injuries and were sent for a forensic examination.

The businessman was arrested in the act and had his arrest converted into preventive custody after a custody hearing. The defense filed a habeas corpus request to try to free him.

WHAT IS MARITAL RAPE

Marital rape is the term used for cases of sexual violence committed by a spouse or partner in a marital relationship. Marriage or the existence of a relationship does not represent permanent consent to sexual relations.

In Brazil, there is no specific crime. The conduct may be classified as the crime of rape, provided for in article 213 of the Penal Code, when there is embarrassment through violence or a serious threat to the practice of sexual intercourse or another libidinous act.
