The publication was accompanied by images generated by artificial intelligence in which Father Júlio Lancellotti appeared dressed in religious robes holding sausages in sexually suggestive poses.
These publications generated a new action by the religious against the comedian. In the decision, published on August 8, judge Daniela Dejuste de Paula stated that the comedian's new publications "directly affected (Father Júlio's) honor and reputation, going beyond the mere discomfort resulting from the exposure inherent to the condition of a public person."
"Acid, uncomfortable, aggressive, vulgar or bad taste humor remains, in principle, protected by freedom of expression", wrote the judge. "There is, however, a difference between blunt criticism or satire and the use of this freedom to attribute a discrediting fact without corresponding documentary support, associating it with the sexualized and vexatious exposure of a third party's image", wrote the judge.
"We are no longer faced only with criticism of the author's public, religious or political actions, nor with satire regarding the result of the legal action, but with the use of his own person, his priestly status and sexual connotations as instruments of ridicule", wrote the judge. The decision, in the first instance, is subject to appeal in higher courts.
