According to the MPMA, the measure was motivated by partial non-compliance with a Conduct Adjustment Term (TAC) signed in 2019. In the decision, the Court ordered the immediate cleaning and vacating of accessible toilets within five days. According to the process, the bathrooms intended for people with disabilities were being used by the administration as material storage and storage. In case of non-compliance, a daily fine of R$1,000 was established, to be charged directly from the personal assets of the responsible public manager. The Court also granted a period of 60 days for the municipality to carry out the engineering works indicated in the expert report.

Among the measures are: installation and readjustment of grab bars in bathrooms; renovation and leveling of the floor in the boarding and arrival area; demarcation and vertical and horizontal signage of spaces reserved for the elderly and people with disabilities. If the adjustments are not completed within the deadline, a daily fine of R$5,000 will be imposed, limited to the value of R$200,000. The decision also recognized as due the fines for the delay accumulated since December 6, 2023. The total amount will be calculated in the sentence settlement phase and allocated to the State Fund for the Protection of Diffuse Rights of Maranhão. The MPMA action was proposed in 2023 with the aim of guaranteeing the accessibility rights of elderly people and people with disabilities provided for in federal legislation. According to the Public Ministry, the municipality spent more than three years without fully complying with the TAC signed in 2019. An expert report carried out in 2025, at the request of the Court, confirmed the irregularities in the terminal's facilities.
